Will Poor Control Keep Former Cub Farmhand Out of Jail?

Former Peoria Chiefs pitcher Julio Castillo pleaded not guily to two charges of felonious assault Wednesday morning in an Ohio courtroom. Castillo was part of that huge on-field brawl between the Chiefs and the Dayton Dragons this past July 24th, at one point firing a ball toward the Dayton dugout, only to have it sail over his target and hit a fan in the head. Castillo's apparent defense is that he never intended to hit the fan, who got a free concussion just for attending the game. Castillo faces up to 16 years in prison and a $30,000 fine if convicted.

Disgusting and idiotic...but feel free to enjoy it all over again.

The Chiefs had one guy named Jon Mueller and another named John Muller pitching for them last season - pretty weird.

Sorry, Charlie. Castillo, in fact, did intend to hit a player on the other team with the ball. So the intention to harm someone was there. The fact that his execution was faulty does not absolve him in any way. It's called transferred intent -- the element of intent is said to be transferred from the intended target to the party who was actually hit. If he had fired gun at the other player but missed and killed a bystander, he could still be charged with murder (presuming the other elements of the crime were satisfied).

He better look for another defense. Maybe he'll claim the other player motioned for him to throw the ball to him....

Is that why he was charged with two counts? The intended target (Dragons player) and the unintended one (the fan)? I couldn't find any clarification of the charges to confirm that, but that was my guess.

I can't comment on that specifically, having not seen the charges. Having said that, your theory sounds pretty good to me.

  • given that he seems to only be throwing low 90s these days rather than the 93-96mph he used to throw, along with his wildness issues this year, he may end up passing through.

    i dunno if something is wrong with him physically or his past shoulder issues has rendered him what he currently is, but he's been throwing a lot of sliders he can't control well and his fastball isn't as sharp. even when his slider wasn't working in a game he was still throwing a lot of them.

    But, I have been an addict for a long time.

    A W tomorrow and it will be a .500 road trip.

    Also, to keep the losses in perspective, if the Cubs were to lose 10 games a month - a lot at this current pace - they still end up 102-60. Six months of the ride!
